The trump paradox
In thinking about the supreme court’s ruling involving Presidential immunity, I thought myself a bit of a paradox. I cannot seem to think my way out of it, but then again, I am just a person not a constitutional scholar; I see it more as a thought experiment than anything else. But I will attempt to lay it out the best I can. We all remember Jan. 6th I presume, there was an investigation in congress and everything. the general consensus from the investigation and corresponding hearing was that there was an attempted insurrection, fomented by Donald J. Trump; Thean conducted by the January 6th defendants. Weather you believe like I do that this is in fact the truth like I do or if you think it was “a witch hunt” it is irrespective, it does not matter; the important part is it happened it was a thing. There where far more then two people who testified to Donalds actions that day, there was an open hearing; witch Donald refused to take part in. again does not matter.
Due to the supreme court ruling, a president now has three very broadly defined buckets their actions fall into; the first would be Constitutional Acts, second is official Acts associated with the job, the last one is personal acts; Witch is the simplest way I can describe the ruling. With this verdict comes a paradox associated strictly with Donald trump, I am calling it the trump paradox. Honestly, I am extremely surprised the right would not be S…Ing bricks over the supreme courts ruling. The paradox goes like this, Joe Biden can now jail Donald trump for January 6th, using the military and Gitmo for treason and terrorism. Treason is defined as the crime of betraying one's country, especially by attempting to kill the sovereign or overthrow the government. The constitution lays out the definition for treason: In Article III, Section 3 of the United States Constitution, treason is specifically limited to levying war against the U.S., or adhering to their enemies, giving them aid and comfort. The constitution as well says No Person shall be convicted of Treason unless on the testimony of two Witnesses to the same overt Act, or on Confession in open Court. Under the definitions for the PATRIOT Act, a political, social, or other similar group whose public endorsement of acts of terrorist activity the Secretary of State has determined undermines United States efforts to reduce or eliminate terrorist activities, civil war talked about by anyone?...
Here is where the Paradox gets odd, Donald J. trump can not be tried for January 6th as technically speaking so if Joe Biden where to throw Donald trump in Gitmo for treason and terrorism Donald would never be able to clear his name as bucket two says he receives immunity for official Acts associated with his job, arguably running for office and holding rallies could be considered an official act. But as well Joe Biden locking Trump away could as well be argued is with in his constitutional obligation. The president shall take the following Oath or Affirmation: – I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect, and defend the Constitution of the United States.
With all the fear from democrats regarding Project 2025, it is a possibility. While I really am disgusted with who Trump is as a human, and do not like most of his policies. I will be the first to tell you that this is a constitutional crisis created by the Highest court in the country, subsequently creating a system where any president can imprison there political rivals, and/or in combination with the patriot act to lock anyone deemed terrorist, in Russia they added Alexei Navalny and 5 of his fellow allies to a list of extremists and terrorist, putting him on the same level as an organization such as ISIS and other international terror organizations. Since the 1990’s a lot of Russian political imitation has taken root in America, since around 2016 the imitation of eastern authoritarian countries has been astounding; the holding up of the likes of Victor Orban to direct talking points for politicians coming out of Russia, these are just a couple off the top of my head example.
How can this be Resolved? Can it?
This ruling should not only concern democrats but it should concern republicans as well. It is just a matter of which side acts first at this point to Defend democracy or take it back, regardless both sides now have legal right to do what ever they like. And that is a big fat F… from me.
