Constitutional Amendment - women's reproductive rights
Section 1 - Right to abortion:
- The 28th Amendment protects the right to privacy in healthcare, to expand protections in the 14th Amendment. a) All abortion procedures must be conducted with the patient’s informed consent, ensuring full understanding of medical risks and alternatives.
b) This includes the right for a woman to make decisions about her reproductive health, including the choice to have an abortion and other medical decisions.
No healthcare provider shall face criminal or civil liability for providing abortion services in accordance with this amendment
A national reproductive health advisory board shall be established to oversee implementation, monitor healthcare outcomes, and provide guidance to states.
a) Federal grants will be provided to states to enhance maternal healthcare infrastructure and ensure equitable access.
- States may establish regulations regarding abortion based on the stages of pregnancy to balance protecting the mother’s health with the potential for human life.
Dividing pregnancy into three trimesters:
During the first trimester, states will Not regulate abortion.
During the second trimester, states will only regulate abortion to protect the mother's health.
During the third trimester, states Can regulate or prohibit abortion to protect the potentiality of human life, except when necessary to preserve the mother's life or health.
Section 3 - States Rights:
- States have the right to determine specific regulations regarding abortion timeframes, provided they adhere to Section 1 of this amendment.
a) Any changes to abortion timeframes must be determined through a public referendum.
b) Exceptions for rape, incest, and when the mother’s life is at risk must be uniformly recognized and implemented.
Section 4 – Funding: To ensure the successful implementation of this amendment, Congress shall allocate federal funding as follows:
- Federal Appropriations:
a) Congress will appropriate funds annually to support reproductive healthcare initiatives, including maternal health programs, abortion services, and family planning resources.
b) These funds will be administered by the Department of Health and Human Services (HHS) to ensure equitable distribution nationwide.
- Grant Programs:
i) HHS will establish competitive and formula-based grant programs to assist states, healthcare providers, and community organizations in:
(1) Expanding access to prenatal and postnatal care.
(2) Improving healthcare infrastructure in underserved and rural areas.
(3) Training healthcare professionals to address maternal and reproductive health needs.
ii) Grant applications will prioritize initiatives that reduce disparities in reproductive healthcare access and outcomes.
- Oversight and Accountability:
a) A national reproductive health advisory board will oversee the allocation and use of funds, ensuring compliance with the goals of this amendment and transparency in expenditures.
